L’unicum irlandese in prospettiva storica e comparata

ABSTRACT

Scopo di questo studio è quello di operare una disamina, in chiave diacronica e comparata, della natura e delle caratteristiche delle university constituencies, sia nel loro ordinamento d’origine (quello inglese), sia in quelli che hanno ereditato la stessa tipologia di distretto elettorale. Dopo aver individuato la natura dell’istituto (e averne specificato i caratteri che lo distinguono da esempi analoghi ma non assimilabili in altri sistemi giuridici), si procederà a esaminarne lo sviluppo storico in Gran Bretagna e nel resto dell’Impero (nelle Tredici colonie nordamericane, in Canada, in Australasia e nel Mediterraneo inglese), concentrandosi però, in particolare, sugli unici ordinamenti che ancora adottano tale circoscrizione, quelli indiano e irlandese. Si analizzerà poi quest’ultimo, individuando i numerosi tentativi e proposte di riforma susseguitisi nel corso dei decenni. Infine, si esaminerà la recente novella legislativa del 2024, e si identificheranno i motivi per cui tale circoscrizione elettorale è ancora considerata, da Dublino, un valido strumento nella scelta dei rappresentanti nell’assemblea legislativa, in quella che può considerarsi una forma vera e propria di (quasi)epistocrazia.

The aim of this research is to examine, from a diachronic and comparative law perspective, the nature and characteristics of university constituencies, both in their system of origin (the English one) and in those that have inherited the same form of electoral district. Having identified the nature of the instrument (and specified the features that distinguish it from similar but non-comparable examples in other countries), the historical development in Great Britain and the rest of the Empire (in the Thirteen North American Colonies, Canada, Australasia and the English Mediterranean) will be examined, focusing, however, on the only systems that still maintain this constituency, the Indian and Irish ones. The latter will then be analysed, highlighting the numerous attempts and proposals for reform that have followed over the decades. Finally, the recent legislative revision of 2024 will be examined, as well as the reasons why this constituency is still considered by Dublin as a valid tool in the choice of representatives in the legislature, in something that can be considered a form of a quasi-epistocracy.
