ABSTRACT

 

La recensione della monografia, scritta da Rachel Walsh, «Property rights and social justice.

Progressive property in action», si pone l’obiettivo di analizzare l’evoluzione della tutela costituzionale della

proprietà privata, nell’ordinamento giuridico irlandese, attraverso le lenti della proprietà progressiva che, a

livello teorico, trova la sua genesi nella riflessione giuridica della dottrina statunitense. Il volume fornisce una

panoramica dettagliata e completa della casistica, che viene analizzata, al fine di comprendere se le Corti

irlandesi siano state influenzate, o meno, dai valori della proprietà progressiva.

 

 

The review of the monograph, written by Rachel Walsh, «Property rights and social

justice. Progressive property in action», aims to analyze the evolution of the constitutional protection of

property rights in the Irish legal system through the lens of progressive property, which, at a theoretical level,

finds its genesis in the legal reflection of the American doctrine. The book provides a detailed and

comprehensive overview of the case law that is analyzed to understand whether the Irish courts have been

influenced by the values of progressive property.
