Il rapporto tra Corona e Camera dei Comuni nell’evoluzione costituzionale inglese

Il lavoro analizza l’evoluzione del rapporto tra la Corona e la Camera dei Comuni nel corso della lunga storia costituzionale britannica, soffermandosi in particolare sulle prerogative regie e sul loro esercizio da parte di altri organi dello Stato.

Tra queste prerogative figura quella dello scioglimento anticipato dell’assemblea, oggetto di disciplina legislativa tra il 2011 e il 2022.

L’abrogazione della legge ha poi ripristinato la prerogativa, restituendo al Primo ministro la scelta politica di disporre lo scioglimento anticipato e indire nuove elezioni.

The paper traces the evolution of the relationship between the Crown and the House of Commons throughout Britain’s constitutional history, with particular regard to the royal prerogatives and their exercise by other constitutional actors.

Among these prerogatives is that of the early dissolution of Parliament, which was placed on a statutory footing between 2011 and 2022.

The subsequent repeal of that legislation restored the prerogative power, thereby returning to the Prime Minister the political discretion to request an early dissolution and to call a general election.
