La tutela ambientale nello UK a dieci anni dalla Brexit: divergenze e convergenze con il diritto dell’UE nella disciplina di una questione globale
Il terremoto istituzionale della Brexit, riguarda anche la dimensione della tutela ambientale. Il diritto ambientale era prima del 2016 nello UK in larga misura “importato” dalle norme UE, e l’uscita dall’Unione europea ha comportato la necessità, soprattutto con il “Withdrawal Act” e la categoria delle “retained laws”, di gestire una complessa transizione giuridica. Fondamentale è stata l’adozione dell’”Environment Act” del 2021, che riprende le basi della tutela ambientale in precedenza calcata sul diritto europeo. Se dal punto di vista del contenuto le modifiche dalla situazione pre-Brexit non sembrano rilevanti, così non è per la mancanza del doppio controllo Commissione e Corte di Giustizia della UE, che può significare una tutela ambientale più debole nella UK di oggi.

Prior to 2016, environmental law in the UK largely derived from UE law, and leaving the EU meant a complex legal transition, fulfilled by the “Withdrawal Act” of 2018 and the category of “retained laws”. The adoption of the 2021 Environment Act has been a fundamental event, reviving the foundations of environmental protection previously based on European law. While the changes from the pre-Brexit situation may not seem meaningful in terms of content, the lack of the dual scrutiny by the Commission and the Court of Justice of the EU is a factor, which could bring weaker environmental protection in the UK today.
